How To File an Assumed Name, or DBA, in Johnson County, Texas ?

Assumed name forms, or DBAs, should be filed with the County Clerk’s Office of the county in which the filing entity is located and will be conducting business. Forms can be completed in person or submitted by mail if notarized. Prior to locally filing an assumed name, you must have filed the information and obtained an Assumed Name certificate and filing number with the Texas Secretary of State.

To ensure the desired assumed name is not already in use, conduct an “Assumed Name Search” by visiting the Texas Secretary of State website.

Step 1: Locate the website for the correct County Clerk’s Office. For Johnson County, the website is www.johnsoncountytx.org

Step 2: On the main home page, locate the Government tab in the menu bar at the top of the page. Hover your mouse over the tab to access a drop-down menu.
• Locate the “County Clerk” section, and under “Land Records & Vitals,” you will find Assumed Names/DBA.Select.

Step 3: From the Assumed Names/DBA page, you will find mailing, filing, and other general information. At the bottom of the page, there are several form options listed. Depending on the type of business entity in which you are filing for, select the appropriate form: incorporated or unincorporated.
• Incorporated includes For-Profit, Non-Profit or Professional Corporation; Professional Association, LLC, LP, LLP, CO-OP, or other.

Step 4 : Once you have selected the correct form, fill in all required information fields. (If hand written, print legibly.)

  • To proceed with filling in the form electronically, you must first download and save the form. The default format for the form is PDF.
  • Once you have accessed the form, in the upper right hand corner select the white downward arrow to download and save onto your device.
  • Access the downloaded form and fill in information about your business accordingly.

If you are unsure about any sections of the form, or have questions or concerns regarding the purpose or process of filing an Assumed Name, please contact an attorney.

  • Type the assumed name exactly how it is to appear on the certificate including punctuation, spaces, and abbreviations.
  • Type the address of the business.
  • Type the period during which the assumed name will be used. The filing maximum is 10 years.
  • From the options provided, circle the correct description of your business entity to properly identify the type of business it will be conducting.
  • Addresses must be a physical address, and cannot be a P.O. Box or other mailing service.

Step 5: When the form is complete, submit it and the filing fee to the County Clerk’s office. All signatures must be notarized prior to submission.
